Dear Valli Vue Homeowners,
On behalf of both myself, as President, and the Board, we invite everyone to attend the upcoming Annual Meeting. This meeting is a platform for us to discuss and decide on important matters that affect our community.
I also want to clarify for the community the recent covenant enforcement process and our progress to ensure fair and consistent application. For many years, covenant enforcement in Valli Vue has been minimal, largely due to the ambiguous fine structure set forth in Administrative Resolution No. 2 (AR2), adopted in 1986, which asks the HOA Board to determine penalties at up to $50 per day for each violation, without structured definition. Understandably, this made our Board reluctant to assess fines because the selected amount might be viewed as arbitrary and capricious. As a result, covenant violations were handled less formally,
with varying degrees of success, when brought to the attention of the Board.
Over the past year, we have received calls for more formal enforcement, including lawsuit threats due to non-enforcement of certain covenants. To address enforcement, our Board chose two courses of action: implement a quarterly drive-through of the neighborhood conducted by our management company to identify covenant violations and develop a reasonable successor to AR2 that specifies the fine structure. Importantly, no fines have been issued thus far—only notifications regarding observed violations.
Some covenants are straightforward, such as the limit of two dogs per household. Others, like the exact placement of RVs or trash cans, have required further clarification. We have sought legal advice to ensure we interpret these rules correctly. For example, we thought bear-proof trash cans might meet the intent of Article V Section 10, but legal counsel recently informed us otherwise. We sought options to modify the covenants to reflect modern realities, but we learned that our HOA is legally required to enforce all covenants as written, without variance.
Revising the covenants requires approval from at least 75% of homeowners. In light of this, the Board has decided to form a Covenant Review Committee. This committee, composed of one board member and several motivated homeowners, will explore the possibility of updating our covenants. The current covenants date back to 1973 and should be updated to reflect the modern needs of our community. The committee’s goal is to explore updates that could reduce common violations and better align the rules with today's realities—such as using bear-proof trash cans, which didn't exist in the 1970s. We recognize that many homeowners may have received letters outlining covenant violations. While this might seem overwhelming, only items explicitly
listed in the covenants are being noted.
